G-cluster plans mobile gaming service to challenge OnLive ...

Japanese cloud-gaming and VOD startup G-cluster plans to enter the U.S. market with an on-demand mobile gaming service, presenting a possible challenge to OnLive. The company has secured an unnamed amount of funding from Intel and Vivendi?s French mobile carrier SFR to expand its reach beyond home casual gaming and movie streaming into high-end gaming for tablets and smartphones.

G-cluster has already established itself in France, providing a casual gaming service through SFR?s residential broadband arm that customers can access through their TVs and set-top boxes or on their Macs or PCs. In Japan, G-cluster is offering an HD movie-on-demand service to connected TVs. But according to Sevan Kessissian, G-cluster VP of Content and Strategy, the startup has bigger ambitions than just casual gaming and video in the domicile. It plans to combine the processing might of the cloud and low-latency, high-bandwidth connections of new wireless networks to create a mobile service that supports high-quality, real-time gaming to tablets and other mobile devices. And it plans to launch that service in the U.S.

?We are in discussion with major partners in order to penetrate the US market? Kessissian said via e-mail. ?The game catalogue will be a blend of the best casual games and AAA games.?

Kessissian didn?t provide any details about which partners G-cluster is in discussions with or when such a U.S. service would launch, but when it finally does emerge here it may find an already established competitor in the market. In December, OnLive announced its mobile gaming service for iOS and Android devices.

My colleague Kevin Tofel reviewed OnLive?s mobile beta on the iPad, over both Wi-Fi and 3G, and was particularly impressed by its performance when hooked into his home network connection. As Kevin pointed out in earlier post, virtualization services like cloud gaming to the tablet and smartphone are proliferating, delivering one more blow to already suffering PC sales.

Willpower and desires: Turning up the volume on what you want most

ScienceDaily (Jan. 30, 2012) ? Trying to resist that late-night tweet or checking your work email again? The bad news is that desires for work and entertainment often win out in the daily struggle for self-control, according to a new study that measures various desires and their regulation in daily life.

"Modern life is a welter of assorted desires marked by frequent conflict and resistance, the latter with uneven success," says Wilhelm Hofmann of the University of Chicago Booth School of Business. Determining how to best resist desires is not as easy as it seems, according to personality and social psychologists who recently presented new research in San Diego about willpower and food psychology.

Resisting desires

In the new study of desire regulation, 205 adults wore devices that recorded a total of 7,827 reports about their daily desires. Desires for sleep and sex were the strongest, while desires for media and work proved the hardest to resist. Even though tobacco and alcohol are thought of as addictive, desires associated with them were the weakest, according to the study. Surprisingly to the researchers, sleep and leisure were the most problematic desires, suggesting "pervasive tension between natural inclinations to rest and relax and the multitude of work and other obligations," says Hofmann, the lead author of the study forthcoming in Psychological Science.

Moreover, the study supported past research that the more frequently and recently people have resisted a desire, the less successful they will be at resisting any subsequent desire. Therefore as a day wears on, willpower becomes lower and self-control efforts are more likely to fail, says Hofmann, who co-authored the paper with Roy Baumeister of Florida State University and Kathleen Vohs of the University of Minnesota.

Scientists who study the complex interplay between desires and self control say that passing up on temptation is made ever more difficult by the idea that there is no single or clear feeling that alerts us to when our willpower is low. "But we find that when willpower is low, everything is felt more intensely," says Baumeister, author of Willpower: Rediscovering the Greatest Human Strength. "Low willpower seems to turn up the volume on life."

In a series of experiments, Baumeister and his colleagues found that people with low willpower reported more distress in response to an upsetting film and rated cold water as more painful during a cold-water immersion test. They also had stronger desires to open a gift and to keep eating cookies.

Postponing a snack

The effects of willpower depletion explain why so many people have trouble resisting unhealthy food -- the more they resist the food, the more they crave it. That's why one group of researchers is looking at ways people can alter their physical cravings. Nicole Mead of Catolica-Lisbon School of Business and Economics and her colleagues tested the notion that postponing consumption of a unhealthy snack to an unspecified future time would reduce the desire for, and therefore consumption of, that snack.

In one experiment, Mead's team gave 105 high school students in the Netherlands a bag of potato chips. Some participants received instructions to either postpone, restrain, or consume the potato chips, while others could choose among the three eating strategies. Over the course of one week, students who initially postponed eating the chips subsequently ate the least amount of the chips, regardless of whether they chose or were given the strategy. They ate even more than those who were instructed to not eat them at all.

"Postponing consumption is an effective strategy that consumers can use for controlling unwanted food-related desires," Mead says. "In modern society, people are absolutely inundated with opportunities to consume, and this strategy may be particularly helpful because it primarily works through desire reduction rather than willpower enhancement." Future research will examine whether the strategy works for other transient impulses, such as spending and sexual desires.

Romney not taking any chances ahead of Fla. vote (AP)

POMPANO BEACH, Fla. ? Mitt Romney isn't taking any chances.

A day before voting begins in Florida's Republican primary, Romney is running ahead of rival Newt Gingrich in polls. The former Massachusetts governor earned positive reviews during two debates. And Romney has put the former House speaker on the defensive over ethics and Freddie Mac.

"It's only when he can mass money to focus on carpet-bombing with negative ads that he gains any traction at all," Gingrich is complaining.

But instead of stepping back and refocusing on President Barack Obama ? as he did in Iowa when it became clear that Gingrich had lost ? Romney is ratcheting up his rhetoric and continuing his attacks until the very end. He hopes to close the Florida campaign strongly to push Gingrich as far back as possible.

"His record is one of failed leadership," Romney said of Gingrich Sunday night at a rally in Pompano Beach, in South Florida. And Romney challenged Gingrich to "look in the mirror" to figure out why the former House speaker has fallen back in Florida.

"His record is one of failed leadership. We don't need someone who can speak well perhaps or can say things we agree with, but does not have the experience of being an effective leader," he said.

Aides say Romney's attacks are partially a response to increasingly angry rhetoric from Gingrich, who on Sunday called the former Massachusetts governor "somebody who is a pro-abortion, pro-gun-control, pro-tax-increase liberal." Gingrich also accused Romney of lying. "I don't know how you debate a person with civility if they're prepared to say things that are just plain factually false," Gingrich said.

Romney's campaign on Sunday fired back immediately, starting with the candidate and continuing with statements from top surrogates who cast Gingrich's assault as an unfair attack on Romney's character.

"Mitt Romney is man of impeccable character," said New Jersey Gov. Chris Christie. "It offends me that Newt Gingrich would attack the character of Mitt Romney."

Former Minnesota Gov. Tim Pawlenty called the attacks "over the line."

Romney's supporters particularly defended his anti-abortion credentials following Gingrich's attack. Gingrich allies are also running radio ads attacking Romney's record on the issue.

Florida Attorney General Pam Bondi called Romney a "champion for pro-life values" as she introduced him at the rally. Rep. Ileana Ros-Lehtinen offered a similar defense during an earlier rally with the Cuban American community in Hialeah.

In what has become a wildly unpredictable race, the momentum has swung back to Romney, who just last weekend was staggered by Gingrich's victory in South Carolina. Romney has begun advertising in Nevada ahead of that state's caucuses next Saturday, illustrating the challenges ahead for Gingrich, who has pledged to push ahead no matter what happens in Florida.

An NBC News/Marist poll published Sunday showed Romney with support from 42 percent of likely Florida primary voters, compared with 27 percent for Gingrich.

To hang onto his lead, Romney continued to paint Gingrich as part of the very Washington establishment he condemns and someone who had a role in the nation's economic problems.

"Your problem in Florida is that you worked for Freddie Mac at a time when Freddie Mac was not doing the right thing for the American people, and that you're selling influence in Washington at a time when we need people who will stand up for the truth in Washington," Romney told an audience in Naples.

Gingrich's consulting firm was paid more than $1.5 million by the federally-backed mortgage company over a period after he left Congress in 1999.

Former Pennsylvania Sen. Rick Santorum, trailing in Florida by a wide margin, skipped campaigning to be with his 3-year-old daughter, Bella, who was hospitalized. He planned to campaign in Missouri and Minnesota early this week.

Texas Rep. Ron Paul, who has invested little in Florida, looked ahead to Nevada. The libertarian-leaning Paul is focusing more on gathering delegates in caucus states, where it's less expensive to campaign. But securing the nomination only through caucus states is a hard task.

The intense effort by Romney to slow Gingrich is comparable to his strategy against Gingrich in the closing month before Iowa's leadoff caucuses Jan. 3. Gingrich led in Iowa polls, lifted by what were hailed as strong performances in televised debates. But his support dropped in the face of withering attacks by Romney, aided immensely by ads sponsored by a "super" political action committee run by former Romney aides.

But Romney aides say they made the mistake of assuming Gingrich could not rise again as he did in South Carolina. Romney appears determined not to let that happen again.

Romney has three events scheduled across the state Monday. He planned events in Jacksonville and the Tampa area. Gingrich has five planned events.

Despair, crackdowns breed more violence in Tibet (AP)

BEIJING ? A young man posts his photo with a leaflet demanding freedom for Tibet and telling Chinese police, come and get me. Protesters rise up to defend him, and demonstrations break out in two other Tibetan areas of western China to support the same cause.

Each time, police respond with bullets.

The three clashes, all in the past week, killed several Tibetans and injured dozens. They mark an escalation of a protest movement that for months expressed itself mainly through scattered individual self-immolations.

It's the result of growing desperation among Tibetans and a harsh crackdown by security forces that scholars and pro-Tibet activists contend only breeds more rage and despair.

That leaves authorities with the stark choice of either cracking down even harder or meeting Tibetan demands for greater freedom and a return of their Buddhist spiritual leader, the Dalai Lama ? something Beijing has shown zero willingness to do.

"By not responding constructively when it was faced with peaceful one-person protests, the (Communist) party has created the conditions for violent, large-scale protests," said Robbie Barnett, head of modern Tibetan studies at New York's Columbia University.

This is the region's most violent period since 2008, when deadly rioting in Tibet's capital Lhasa spread to Tibetan areas in adjoining provinces. China responded by flooding the area with troops and closing Tibetan regions entirely to foreigners for about a year. Special permission is still required for non-Chinese visitors to Tibet, and the Himalayan region remains closed off entirely for the weeks surrounding the March 14 anniversary of the riots that left 22 people dead.

Video smuggled out by activists shows paramilitary troops equipped with assault rifles and armored cars making pre-dawn arrests. Huge convoys of heavily armored troops are seen driving along mountain roads and monks accused of sedition being frog-marched to waiting trucks.

For the past year, self-immolations have become a striking form of protest in the region. At least 16 monks, nuns and former clergy set themselves on fire after chanting for Tibetan freedom and the return of the Dalai Lama, who fled to India amid an abortive uprising against Chinese rule in 1959.

China, fiercely critical of the Dalai Lama, says Tibet has been under its rule for centuries, but many Tibetans say the region was functionally independent for most of that time. Anger over cultural and religious restrictions is deepened by a sense that Tibetans have been marginalized economically by an influx of migrants from elsewhere in China.

In a change from the individual protests, several thousand Tibetans marched to government offices Monday in Ganzi prefecture in Sichuan province. Police opened fire into the crowd, killing up to three people, witnesses and activist groups said.

On Tuesday, security forces opened fire on a crowd of protesters in another area of Ganzi, killing two Tibetans and wounding several more, according to the group Free Tibet.

On Thursday in southwestern Sichuan province's Aba prefecture, a youth named Tarpa posted a leaflet saying that self-immolations wouldn't stop until Tibet is free, the London-based International Campaign for Tibet said. He wrote his name on the leaflet and included a photo of himself, saying that Chinese authorities could come and arrest him if they wished, group spokeswoman Kate Saunders said in an email.

Security forces did so about two hours later. Area residents blocked their way, shouting slogans and warning of bigger protests if Tarpa wasn't released, Saunders said. Police then fired into the crowd, killing a a 20-year-old friend of Tarpa's, a student named Urgen, and wounding several others.

The incident, as with most reported clashes in Tibetan areas, could not be independently verified and exact numbers of casualties were unclear because of the heavy security presence and lack of access. The topic is so sensitive that even government-backed scholars claim ignorance of it and refuse to comment.

The government, however, acknowledged Tuesday's unrest, saying that a "mob" charged a police station and injured 14 officers, forcing police to open fire on them. The official Xinhua News Agency said police killed one rioter and injured another.

"The Chinese government will, as always, fight all crimes and be resolute in maintaining social order," Foreign Ministry spokesman Hong Lei said in comments on the incident.

In a commentary Sunday, the nationalist tabloid Global Times repeated accusations that the protests were inspired by Tibetan exile groups and their demands were out of step with the desire for economic development.

Yet, it also conceded that the Dalai Lama retained considerable religious influence over Tibetans, warning this created a dangerous trend of "melding the political and relgious."

The harsh response points to a deep anxiety about the self-immolations, said Youdon Aukatsang, a New Delhi-based member of the Tibetan parliament-in-exile.

"They're worried that there is an underground movement in Tibet that is coming to the surface," she said.

Tibetan desperation has been fed both by the harsh crackdown ? security agents reportedly outnumber monks in some monasteries ? along with a deep fear that the Dalai Lama, probably the most potent symbol of Tibet's separate identity, will never return.

The 76-year-old Nobel Peace Prize laureate handed his political powers to an elected assembly last year. That was intended to ensure the Tibetan cause would live on after him, but was met with considerable anxiety among many Tibetans who saw it as a sign he was giving up his role as leader of their struggle.

Dibyesh Anand, a Tibet expert at London's University of Westminster, said resistance to Chinese rule is likely to grow more fierce.

"Protests will get more radicalized since the Tibetans in the region see no concession, no offer of compromise, no flexibility coming from the government," he said.

US man helping in Haiti rebuilding is shot, robbed (AP)

MIAMI ? A U.S. man who helped build a trauma center in Haiti after January 2010's devastating earthquake was treated at that hospital after being critically wounded during a robbery in the capital of Port-au-Prince, his wife and doctors said Friday.

David Bompart, 50, of Columbus, Ohio, was shot Tuesday afternoon outside a bank and was in critical condition Friday at a Florida hospital. Bompart was picking up money for an orphanage building project when robbers sprayed bullets at him at close range. He was hit but able to walk to a nearby Project Medishare hospital for help, said his wife, Nicolle Bompart, 45.

The robbers stole his camera and passport, but the money for the orphanage remained safe in Bompart's pants pocket, his wife said. The suspects have not been arrested.

"I feel like this was a robbery (by) some people who were desperate to feed their families, and I choose to look at it as that's why they did it," Nicolle Bompart said.

He underwent two surgeries at Hospital Bernard Mevs Project Medishare before he was airlifted Thursday night to a Miami hospital, said spokeswoman Catherine Murphy.

Bompart was on a ventilator at the Ryder Trauma Center and had gunshot wounds to the chest and abdomen, said Dr. Nicholas Namias, the center's co-medical director.

"What we're dealing with now are the effects of being in shock for a long time in Haiti," Namias said.

Bompart managed Project Medishare's warehouse and logistics, said co-founder, Dr. Barth Green.

Since October, Bompart had been working on building the orphanage through the couple's own charity, Eyes Wide Open International, said his wife, who flew to Haiti after the shooting.

The couple has spent much of their time since January 2010 flying between Haiti, Florida and Ohio for their charity work and for medical care for their 14-year-old son, a Haitian boy they adopted after the earthquake. The Bomparts also have a 26-year-old daughter.

Bompart knew about the potential risks of working in Haiti's capital, which had been prone to instability and violence before the earthquake. But he was devoted to helping widows and orphans in Haiti and he felt he could rely on his training as a former United Nations employee and as a member of the military in his native Trinidad and Tobago, his wife said.

"Honestly, if he was able to tell you, he would say that he would do it all over again, if it would change someone's life or bring awareness to this situation," Nicolle Bompart said. "He would still do it, because that's the kind of guy he is."

Google Authenticator / CyanogenMod incompatibility fixed

Android Central

Last night's update to the Google Authenticator app caused headaches for a few CyanogenMod users by force-closing at startup on their devices. However, CM users will be pleased to hear that a fix has been swiftly rolled out by Google just hours after the incompatibility came to light. To grab the fix, simply head on over to the Android Market and hit that "update" button.

Kudos to Google for making a fix available so quickly, especially given the critical nature of the Authenticator app for its users, and the fact that the glitch only affected unofficial custom firmware.

Continue past the break for the usual Android Market linkage.

Pesticide may worsen honeybee virus

A common pesticide used by beekeepers to kill honeybee-infecting mites temporarily leaves the bees more susceptible to a debilitating virus, new research suggests.

From parasitic flies to numerous viruses, honeybee colonies across the globe have a lot of things threatening their survival, but perhaps no stressor is as disastrous as varroa destructor mites. The tiny vampiric arachnids latch onto bees of all stages of life and suck their "blood." Often in the process, the mites deliver to the bees deformed wing virus ? which causes wing disfigurements in developing pupae, resulting in flightless bees that die shortly after their emergence. Both these mites and the deformed wing virus have been implicated in colony collapse disorder, and together they can wipe out an entire honeybee colony within a few years if left untreated, scientists have found.

The most successful weapon against these mites (at least those that haven't developed a resistance) has been pesticides called acaricides. However, scientists know little about the chemicals' effects on honeybee viruses. To find out, Joachim de Miranda, a bee ecologist at the Swedish University of Agriculture Sciences in Uppsala, Sweden, and his colleagues studied the effects of the common acaricide Apistanon levels of several viruses in honeybees.

To their surprise, they found that concentrations of deformed wing virus in treated bee colonies initially increased for a period, before ultimately dropping when more mites died (though the virus levels didn't fall below those seen in untreated colonies until the last week of the six-week treatment used in the study).

If future studies conclusively show that Apistan causes a spike in the virulence of deformed wing virus, the findings could have implications for beekeepers, the researchers say.

"Make sure that you know that you absolutely have to treat before treating with acaricides," de Miranda told LiveScience. "If you don't have a lot of mites, then this treatment will only cause you more damage."

Of mites and viruses
During the winter, honeybees do not hibernate, but instead cling tightly together on the combs in the hive to form insulating "clusters." While in the cluster, the bees still rear young and consume food, but all reproduction is stopped. Because the bees need a critical number of members to effectively block out the cold, the colony must be healthy before and during the chilly season.

"They have to be as healthy as possible going into the winter to survive and produce the next generation during the spring before dying off," de Miranda explained.

Previous studies showed that colonies that were effectively mite-free were still dying over winter, and bees that died had elevated levels of deformed wing virus, said Stephen Martin, a varroa mite expert at the University of Sheffield in the United Kingdom, who was not involved in the current research. "What we suspect is that the virus has now changed ? it was initially reliant on varroa, but now virulent forms don't rely on that kind of transmission," Martin said, referring to the fact that over the winters, when the mites are dead, the virus can still be transmitted to other bees through their regurgitated food.

In light of this fact, beekeepers need to know how soon before winter they need to start treating their colonies for varroa mites, to ensure that the bees make it to spring.

A balance of evils
The researchers don't yet know what could have caused the initial spike they saw in deformed wing virus in the pesticide-treated bees, but suspect that Apistan could be working synergistically with the virus against the bees; alternatively, the chemical may be negatively affecting bee immunity, leaving them more vulnerable to the deformed wing virus.

Whatever the case, the study doesn't conclusively show that Apistan had an effect on virus levels, and the results could just be a statistical anomaly, Martin told LiveScience. The researchers are now looking to test how Apistan affects virus levels in the absence of varroa mites.

De Miranda doesn't think beekeepers should be alarmed, because the virus spike wasn't significant enough to cause major damage, though using pesticide to treat bees with just low levels of the mites may not be the best idea. Colonies highly infested with mites need to be treated, he said, adding that "you have to see it as sort of a balance of different evils."

At the very least, the study shows that beekeepers should probably treat their colonies for more than six weeks ahead of chilly weather, because there were still substantial levels of deformed wing virus at the end of the study treatment.

"Beekeepers need to be aware that viruses don?t sit still and things are continually changing," Martin said. Fifteen years ago acaricides that killed mites also reduced virus levels, but this is clearly not happening anymore, he said. "Things are not as straightforward as we once believed."

The study was published in the January issue of the journal Applied and Environmental Microbiology.

Nigerian police say four Boko Haram members killed (Reuters)

MAIDUGURI, Nigeria (Reuters) ? Nigerian police said on Monday they shot dead four members of the Islamist sect Boko Haram in the northeast city of Maiduguri and recovered explosive materials stored in a car, two days after the sect carried out its most deadly attacks.

Bomb attacks and fierce gun battles between the sect and police on Friday in Nigeria's second largest city Kano killed at least 178 people, according to hospital staff. Kano is hundreds of kilometers west of Maiduguri, Boko Haram's home town.

"Four members of Boko Haram sect involved in killings in Maiduguri and environs have been under surveillance of security agencies and have been shot dead in Pomomari area of Maiduguri yesterday (Sunday)," Colonel Victor Ebhaleme, an officer in the joint military task force, said in a statement.

"Various IED (improvised explosive device) materials prepared for detonation were recovered from their car."

Boko Haram, which was formed in Maiduguri in 2002, has killed hundreds of people in the last year, mostly in and around its home state of Borno, though its attacks have been spreading across the north of Africa's most populous nation.

Residents in Kano, a city of more than 10 million people, began to return to work on Monday amid a heavy military presence as soldiers searched vehicles at dozens of checkpoints set up on the city's wide, dusty streets.

President Goodluck Jonathan has been severely criticized for not getting a grip on Boko Haram, a group he says have infiltrated the police, military and all areas of government.

Boko Haram, a Hausa term meaning "Western education is sinful," is loosely modeled on Afghanistan's Taliban.

The sect originally said it wanted sharia, Islamic law, to be applied more widely across Nigeria but its aims appear to have changed.

The sect focuses its attacks mostly on the police, military and government, but has attacked Christians more recently. It says it is fighting enemies who have wronged its members through violence, arrests or economic neglect and corruption.

Groundbreaking jazz manager John Levy dies at 99 (AP)

ALTADENA, California ? John Levy, the first prominent African-American personal manager in the jazz or pop music field, whose clients included Nancy Wilson and Ramsey Lewis, has died at age 99.

Devra Hall Levy posted on his website that her husband died Friday in his sleep at his home in Altadena, California, less than three months before his 100th birthday.

An accomplished bassist, the New Orleans-born Levy performed with such jazz greats as Stuff Smith, Billie Holiday, Erroll Garner and Billy Taylor in the 1940s before joining pianist George Shearing's original quintet. In the early 1950s, he became Shearing's full-time manager and later went on to form his own management agency, John Levy Enterprises Inc.

Levy's client roster over the years included more than 85 artists, including Wilson, Lewis, Nat and Cannonball Adderley, Betty Carter, Roberta Flack, Herbie Hancock, Shirley Horn, Freddie Hubbard, Ahmad Jamal and Abbey Lincoln as well as comedian Arsenio Hall.

In 2006, the National Endowment for the Arts recognized Levy as a Jazz Master, the nation's highest jazz honor.

S.F. sheriff pleads not guilty to spousal abuse (Reuters)

SAN FRANCISCO (Reuters) ? San Francisco Sheriff Ross Mirkarimi pleaded not guilty on Thursday to misdemeanor counts of domestic violence battery, child endangerment and dissuading a witness, in a contentious hearing that saw his wife sharply criticize the judge.

Speaking out in court on Thursday, Mirkarimi's wife and an alleged victim in the case, Eliana Lopez, 36, insisted in vain that San Francisco Superior Court Judge Susan Breall drop an order barring her husband from contact with her and their 2-year-old son, Theo.

"The real violence against me is pulling my family apart," said Lopez, a Venezuelan television actress, who brushed tears away as the hearing began.

The charges stem from an incident on New Year's Eve in which the couple quarreled about Lopez's plans to take Theo on a trip to Venezuela, according to both a police affidavit and Mirkarimi's attorney.

Police said Lopez ran screaming into the street outside the couple's home and showed a neighbor, Ivory Madison, a bruise on her arm. Madison made a video of Lopez displaying the injury, and later shared it with police over Lopez's objections.

In the video, Lopez said, "This is the second time this is happening ... I been telling him we need help and I'm going to use this just in case he wants to take Theo away from me because he did said that he is very powerful and can do it," according to the police affidavit.

Assistant District Attorney Elizabeth Aguilar Tarchi said the video and later text messages exchanged between Lopez and Madison show Lopez lives in fear of her husband and that he threatened to take Theo away from them.

Breall asked that Lopez meet with a domestic violence counselor in the district attorney's office before testifying before the court.

"It's very helpful for someone like Ms. Lopez," the judge said. "I understand from reading the newspaper that Ms. Lopez has only been in this country for a couple of years. She doesn't have the support of a mother or father or sister or brother."

Lopez complied with Breall's suggestion immediately -- meeting with the counselor while the court considered other cases -- then returned an hour and a half later to forcefully argue for her husband.

"This picture of the little poor immigrant is insulting," she told the judge. "And in a diverse city like San Francisco, it's a little racist."

She pointed out that she has supported herself since age 20, has lived in several different countries, still owns a large apartment in Venezuela and continues an active career as an actress. Lopez has appeared in telenovelas, a Spanish-language soap opera genre, in Venezuela.

"I don't need the support of my family because I support them," she said. "I love Ross and the only reason I came to this country was to have a family with him."

She patted Mirkarimi on the shoulders before sitting down.

Breall said she was impressed -- but proceeded to renew an order barring Mirkarimi from all contact with Lopez and Theo. "I have to take the affidavit into consideration," she said.

Outside the courtroom, Lopez showed off a T-shirt she made with Theo showing her hand, Theo's hand and Mirkarimi's hand all reunited.

Mirkarimi, 50, was sworn in on January 8 as the first new sheriff San Francisco has seen in three decades. The former member of the San Francisco Board of Supervisors narrowly won an election in November after incumbent Sheriff Michael Hennessey announced his retirement.

The investigation had already begun when he took office. Charges were filed on January 13.

Mirkarimi is a Chicago native who has lived in San Francisco for 27 years, according to his campaign website. He was a district attorney investigator in San Francisco before his election to the Board of Supervisors in 2004.

On Thursday, some of Mirkarimi's allies, including former San Francisco Mayor Art Agnos, sat in court to show their support. The sheriff himself kept silent during the court hearing.

A family court hearing in the case was set for Monday.

China GDP growth at 2-1/2 year low but tops forecast (Reuters)

BEIJING (Reuters) ? China's economy grew at its weakest pace in 2-1/2 years in the latest quarter and it appeared headed for an even sharper slowdown in the coming months as export demand fades and the housing market falters.

The fourth-quarter year-on-year growth of 8.9 percent, although slightly stronger than the 8.7 percent that economists polled by Reuters had predicted, may give Beijing yet another reason to gently ease monetary policy, most likely by reducing the amount of reserves that large banks must hold.

The data released on Tuesday may not satisfy investors, who were looking for figures that were either weak enough to provide a clear-cut case for policy easing or strong enough to allay fears that the world's second-biggest economy might unravel.

"The slowdown is not scary, so we are not going to get massive policy easing," said Kevin Lai, an economist with Daiwa in Hong Kong.

Shanghai stocks pared gains in low-volume, volatile trading after the data was released. The euro and Australian dollar both extended gains against the U.S. dollar as investors took some solace in the fact that China's growth rate was a bit faster than expected.

With Europe in danger of slipping into a recession and U.S. growth looking lackluster, China's role in the global economy is magnified.

Although economists widely expect China's 2012 growth will be the weakest in a decade, a more pronounced slowdown would put a major drag on already shaky global growth.

The fourth-quarter growth rate was the slowest pace since the second quarter of 2009, when the global economy stumbled out of a deep recession. It also marked the fourth straight quarter in which growth slowed down.

Ma Jiantang, the head of China's statistics agency, said China's growth was likely to slow further as Beijing tries to restructure the economy away from exports and towards domestic consumption -- something the United States and other trading partners have long pressed China to do.

Tuesday's data showed net exports subtracted from 2011 growth while consumption contributed more than half.

Some analysts think China's first-quarter growth will be below 8 percent threshold seen as the minimum for assuring sufficient job creation.

"Further weakness lies ahead," Mark Williams, an analyst at Capital Economics, said before the fourth-quarter data was released.

"European demand for Chinese products has already slowed and is likely to remain subdued. The outlook for real estate construction -- a 10th of GDP -- is potentially an even greater concern."

Europe is China's top export market, and all signs point to much of the continent falling into recession in coming months, with no end in sight as governments push austerity programs.

Mass ratings downgrades in the euro zone over the weekend and a breakdown in Greek bailout talks have added to financial market jitters.

NEW YEAR SKEW

An early Lunar New Year holiday on January 23-24 probably skewed the fourth-quarter data and the effect will likely linger through the first three months of the year.

Factories typically step up production to clear orders before the festive period, and then temporarily shut down as workers head home to visit family.

That means fourth-quarter growth probably benefited from the surge in manufacturing, while first-quarter activity will be even slower.

"We are in a period where the early Chinese New Year is boosting activity ahead of the holiday, which is setting us up for a disappointment after," Ken Peng, an economist at BNP Paribas, said before the data release.

Peng sees China's annual economic growth slipping to 7.9 percent in the first quarter, the worst in three years.

A BOTTOM IN Q1?

Other Chinese data painted a mixed picture of the economy.

Retail sales grew 18.1 percent from a year earlier in December, faster than the consensus of a Reuters poll of 17.2 percent. Industrial output also exceeded expectations, up 12.8 percent year on year.

But housing investment dropped precipitously in December, and many property developers have warned that 2012 looks grim.

A booming housing market helped drive China's explosive growth in recent years, but Beijing has tried to cool prices in hopes of avoiding a devastating bubble and bust.

A modest housing market slowdown would be a welcome development, but a crash would be catastrophic, both for China and its trading partners around the world.

Some analysts think a more pronounced economic slowdown in the first quarter could be a blessing in disguise of sorts.

It may compel stability-obsessed Beijing to unveil more stimulus measures this year, giving the Chinese and world economy the lift that many investors are hoping for.

Possible stimulus could include further cuts in the levels of reserves that banks need to set aside at the central bank, and more aggressive state investment aimed at providing more public housing for low-income households.

Daiwa's Lai expects four cuts of 50 basis points each in bank reserves in 2012.

The central bank cut bank reserves in November for the first time in three years in a signal from Beijing of its concern about the economic slow down, reducing levels for big banks to 21 percent from a record 21.5 percent.

Beijing has also allowed the pace of bank lending to pick up and the central bank is injecting cash into money markets.

"When growth dips to below 8 percent, the political consensus for protecting growth will be stronger. That helps to bring back activity," Peng from BNP Paribas said.

JURIST - Paper Chase: Two business groups challenge Obama's ...

Two business groups challenge Obama's recess appointments
Julia Zebley at 11:28 AM ET

[JURIST] Two business advocacy groups filed motions [press release] in the US District Court for the District of Columbia [official website] on Friday, contesting the constitutionality of US President Barack Obama's [official website] recent recess appointments [JURIST report]. The National Right to Work Foundation (NRWF) and the National Federation of Independent Business (NFIB) [advocacy websites] contend that the recess appointments are not constitutional as the Senate was technically in a pro forma session, thus providing no recess during which Obama could make appointments. The motions were filed in relation to the groups' ongoing suit challenging the National Labor Relations Board (NLRB) [official website] mandate that rights to unionize [JURIST report] be posted in all workplaces. In a press release, the NFIB also stated that they have amended their complaint [text] to include new charges that the NLRB cannot function to enforce new rules, in part due to Obama's recess appointments:
The President's action was a surprise and terrible disappointment to small-business owners throughout the country who have suffered under the unabashedly pro-union rule-makings handed down by the NLRB. These alleged recess appointments are a brazen circumvention of the Congressional appointment process and raise serious legal concerns that cannot be ignored. The outrage amongst members of the small-business community is severe, and NFIB takes this action today to ensure that its members are protected from unconstitutional acts that exacerbate the NLRB's devolution from a neutral arbiter between labor and employers to a pro-union government agency.
Earlier this month, Obama used recess appointments to install Richard Cordray [WP backgrounder] as director of the Consumer Finance Protection Bureau [official website] and appointed [press release] Sharon Block, Terence F. Flynn and Richard F. Griffin as new board members for the NLRB.

The US Department of Justice (DOJ) [official website] defended the use of recess appointments [CRS backgrounder, PDF] by Obama immediately after his announcement. The Recess Appointment Clause [Constitution, Article II, ? 2 text] gives the president the "power to fill up all vacancies that may happen during the recess of the Senate." The DOJ's memo argues that although the Senate met between January 3 and 23, the sessions were not sufficient to constitute an interruption of a recess under the Recess Appointment Clause because they were only pro forma sessions that lasted less than a minute and there was no intent to conduct any business. Some experts argue that recess appointments have regularly been used by presidents [JURIST op-ed] since George Washington. It is only a relatively recent practice that obstructionists have begun holding perfunctory pro forma sessions every three days while the Senate is on recess in order to block recess appointments.

Nigerian oil union threatens to shut down crude output (Reuters)

PORT HARCOURT/LAGOS (Reuters) ? Nigerian oil workers threatened on Wednesday to shut down output in Africa's top crude producer, deepening a national strike over a more than doubling of petrol prices.

With the government and unions locked in a showdown which has paralysed Nigeria for three days, the biggest oil union said it would make a decision later in the day, although industry officials doubted it could shut down crude exports completely.

"We are not on the streets today because by the evening ... the national leadership of the oil workers will announce its decision on when to shut down production as well as export terminals," Chika Onuegbu, national industrial relations officer of oil union PENGASSAN, told Reuters.

A definite decision to strike had yet to be made, but he added: "That will mark the beginning of the next phase of the protest against the removal of fuel subsidy and it will be very disastrous for the country."

Nigeria exports over 2 million barrels of crude oil per day and is a major supplier to the United States and Europe. Output has been unaffected so far but concerns about Nigerian supply can move global oil prices.

Oil industry officials said a complete halt to oil exports was unlikely because processes are automated and some workers non-unionized. However, even a small dent in output would heap pressure on President Goodluck Jonathan's government, which relies on crude exports for 95 percent of Nigeria's foreign exchange earnings and most of its state revenue.

Tens of thousands of Nigerians gathered across the country of 160 million people in protests that have focused anger about decades of corruption and economic mismanagement.

Workers vowed to keep up the indefinite strike unless the government restored a fuel subsidy it scrapped on January 1, but Jonathan's government said it would withhold pay from civil servants who join it.

Economists say the subsidy would soon have bankrupted the country. But its removal more than doubled the petrol price to 150 naira ($0.93) a liter, depriving Nigerians of what many regarded as their only welfare benefit.

At a rally in the commercial capital Lagos, protesters sang and chanted slogans urging the government to go after corrupt leaders, not state welfare.

Police shot one demonstrator when they fired on a group they accused of rioting, a Reuters reporter saw. Protests have mostly been peaceful, but deadly confrontations with police have happened in Lagos and the second largest city, Kano.

In Lagos on Wednesday, youths at flaming roadblocks tried to prevent cars moving, groups of protesters marched and waved flags and a few hand-to-mouth traders sold fruit juice or mobile phone credit, their only means of survival.

Protesters marched through the capital, Abuja, and thousands gathered in Kano, in the north.

Onuegbu said the "only option" was for the government to restore the subsidy to "create room for discussion."

SHUTDOWN

Banks, restaurants and shops were shuttered up, evidence that the strike is already badly damaging the economy, in which most people live on less than $2 per day.

But none of the damage done so far would match a shutdown of oil exports. The strike has not affected oil output yet, industry officials say, though the offices of companies such as Shell and Exxon Mobil are shut.

The strikes risk creating shortages of basic goods.

"I have stocks lasting a week but I'm running out of supplies," said David Negedu, 32, a financial analyst in the middle class Lekki neighborhood, who supports the strike. "You want to get back to work, but yet again we want this action ... until the government comes up with a plan that makes sense."

President Jonathan now has two major security problems - opposition to the fuel price rise and growing sectarian strife started by the Islamist militant group Boko Haram.

Jonathan has stood firm on removing the subsidy in a nation which despite being a top crude producer has to import many of its oil products due to a shortage of refining capacity - partly because cheap fuel prices have discouraged investment.

VIOLENCE FLARES

Scores of passengers were stranded by cancelled flights at Lagos international airport, many of them sleeping on the floor as they waited in vain for airlines to resume services.

"It's the population that is suffering the most from this strike," said an African diplomat in Lagos. "I think the government and labor will have to come to a compromise where both will shift their ground just to end it."

There was no sign of that on Wednesday. "The Jonathan presidency must wake up to the reality that Nigerians ... have spoken out across the country against the fuel price hike and it will do well to listen," the unions said in a statement.

Jonathan has been unwilling to yield to protests similar to those that derailed past attempts to scrap the subsidy, and the attorney general said late on Tuesday that striking public sector workers would not be paid.

The government estimates it will save 1 trillion naira ($6 billion) this year by eliminating the subsidy, freeing up money for roads, railways and poverty alleviation.

Around three thousand demonstrators from Jonathan's Ijaw ethnic group held a pro-government counter-rally in the southeastern oil city of Yenagoa

Some protests have turned violent. A mob killed five people in an attack on a mosque in southern Nigeria on Tuesday, taking advantage of the civil disorder to settle sectarian scores and highlighting the nation's worsening fragility.

Police shot dead two people and wounded at least two dozen during protests on Monday.

Suspected Boko Haram members on motorbikes opened fire on a bar in the northeastern town of Potiskum on Tuesday, killing eight people, the local police commissioner said, one policeman and seven civilians, including one woman.

Jonathan has been criticized for failing to quell Boko Haram, whose insurgency is rooted in the largely Muslim north but which is increasingly targeting Christians from the south --

most recently in attacks on churches that have killed dozens and provoked reprisals against Muslims.

With the government and unions locked in a showdown which has paralyzed Nigeria for three days, the biggest oil union said it was ready to halt oil production, although industry officials doubted it could shut down crude exports completely.

"Now that the Federal Government has decided to be callous minded, we hereby direct all production platforms to be on red alert in preparation for total production shutdown," Babatunde Ogun, president of oil union PENGASSAN, said in a statement.

A definite decision to halt output had yet to be made, but Ogun said workers were already not sending production reports back to the government, which was "one of the very first steps in shut down process".

In response, the government urged unions to negotiate.

"The government is worried about the threat to shut down oil production because if they go ahead to carry out their threat that action will worsen our economic problem which the government is trying to solve, this is why the government is calling on labor and the civil society to come for dialogue," Labaran Maku, minister of information, said via email.

Nigeria exports over 2 million barrels of crude oil per day and is a major supplier to the United States and Europe. Output has been unaffected so far but concerns about Nigerian supply can move global oil prices, although they were down on Wednesday as traders worried more about the European economy.

Oil industry officials said a complete halt to oil exports was unlikely because processes were automated and some workers non-unionized. However, even a small dent in output would heap pressure on President Goodluck Jonathan's government, which relies on crude exports for 95 percent of Nigeria's foreign exchange earnings and most of its state revenue.

NO SAVINGS

"If there is any disruption to oil production it would be a serious escalation and the government would be likely to use legal or enforcement means to stop it. But I think it is unlikely oil output will be affected," said Kayode Akindele, partner at Lagos-based investment firm 46 Parallels.

"The government will be fairly confident that as long as the security services can keep things under control then people will have to start going back to work. Most people don't have savings so they can't afford to lose out on days of pay."

Tens of thousands of Nigerians have gathered across the country of 160 million people in protests that have focused anger about decades of corruption and economic mismanagement.

The government estimates it will save 1 trillion naira ($6 billion) this year by eliminating the subsidy, freeing up money for roads, railways and poverty alleviation.

The subsidy distorted the local energy market with heavy duty vehicles running on petrol rather than diesel - a more appropriate fuel but which had been more expensive as it was not subsidized.

Son of Packers assistant coach missing

(AP)?

OSHKOSH, Wis. - Authorities were searching for the 21-year-old son of Green Bay Packers offensive coordinator Joe Philbin on Monday, a day after he was reported missing following a night out with friends.

Michael T. Philbin was last heard from around 2 a.m. Sunday. Oshkosh Police spokesman Joseph Nichols said one of Michael Philbin's friends reported him missing at 8:15 p.m. Sunday.

Philbin had traveled from his home in Ripon to Oshkosh to meet friends, Nichols said. They went out together in the campus area Saturday evening but when the group decided to move on to another establishment Michael Philbin apparently chose to stay behind, he said.

Philbin made a cellphone call to one of his friends at 2 a.m. but didn't say where he was, Nichols said. Philbin didn't sound as if he was under duress or suffering from any medical issues and the call ended amicably, Nichols said.

But he never returned to get his car on Sunday and never tried to contact anyone, prompting the call to police, Nichols said.

Investigators have checked video surveillance from campus-area establishments, contacted the county jail and area hospitals in hopes of locating him, but so far they've turned up nothing. Attempts to track his cellphone were unsuccessful and police in Ripon, about 20 miles away, turned up nothing when they went to his home, Nichols said.

Sheriff's deputies were looking into a report of cries for help from the Fox River, but investigators had not established any links to the Philbin disappearance, Nichols said. The Winnebago County Sheriff's Department said divers were searching for someone who apparently fell through the ice.

The disappearance comes as the Packers prepare for Sunday's home playoff game against the New York Giants.

Coach Mike McCarthy said Philbin was in Oshkosh on Monday, and said the team has contingency plans in place if Philbin can't be there this week.

"We're supporting Joe and his family the best we can, and we're holding out hope that this comes to a positive conclusion," McCarthy said.

"The Packers organization is aware of the missing person report regarding Michael Philbin, son of offensive coordinator Joe Philbin," Packers general manager Ted Thompson said in a statement. "Our thoughts and prayers are with the Philbin family during this difficult time."

Joe Philbin has been with the Packers since 2003, and has been the team's offensive coordinator since 2007. He interviewed for the Miami Dolphins' vacant head coaching job last week.

Michael Philbin was sentenced to six months in jail in 2009 after he was convicted of sexually assaulting two young girls.

Nash's 17 assists help Suns rout Bucks 109-93 (AP)

PHOENIX ? Steve Nash had 17 assists and 10 points in 27 minutes as the Phoenix Suns routed the weary and short-handed Milwaukee Bucks 109-93 on Sunday night.

The Suns beat the Bucks in Phoenix for the 24th straight time, the NBA's second-longest active streak behind San Antonio's 27 wins in a row at home over Golden State.

Phoenix shot 58 percent, led by Marcin Gortat, who scored 18 points on 9-of-10 shooting. Channing Frye went 6 of 7 and made all four 3-point tries to finish with 16 points. Seven players, including all five starters, reached double figures for the Suns.

Tobias Harris scored 15 for the Bucks at the end of an 0-5 road trip. Milwaukee last won in Phoenix on Feb. 21, 1987.

Grant Hill added 14 points, Shannon Brown scored 14, Markieff Morris 13 and Jared Dudley 11 for Phoenix, which has won two in a row for the first time this season. The Suns made 9 of 20 3-pointers, 3 of 3 by the rookie Morris, who had a team-high 10 rebounds.

Shaun Livingston scored 12 for Milwaukee, Ersan Ilyasova and Jon Leuer 11 apiece. The Bucks were without four players, including Andrew Bogut, who was returning from Australia after attending to personal matters and is expected to play Tuesday against San Antonio. Luc Mbah a Mouti (right knee tendinitis), Beno Udrih (left shoulder strain) and Mike Dunleavy (groin) also sat out.

Both of the latest Suns victories were one-sided affairs against worn-out teams playing the second of back-to-back nights. On Friday, the Suns routed Portland 102-77 a night after the Trail Blazers had beaten the Los Angeles Lakers. The Bucks lost to the Clippers 92-86 in Los Angeles on Saturday and played for the fifth time in eight nights.

Nash had 10 assists in the first quarter, two shy of his franchise record, as the Suns shot 68 percent (13 for 19) but led only 30-25.

Milwaukee cut it to 45-43 when Larry Sanders dribbled the length of the court for a dunk with 4:09 left in the half. Consecutive 3-pointers by Frye, who was 4 for 23 on 3s entering the game (17 percent), ignited a 10-2 run that put Phoenix up 55-45 after Gortat took a pass from Dudley for a layup. The Suns led 57-47 at the break.

Phoenix turned the game into a rout with a 17-4 third-quarter outburst, capped by Dudley's 17-footer that put the Suns up 87-60 with 3 1/2 minutes left in the quarter. Nash had three straight assists in the run ? for a layup by Gortat, a three-point play by Hill and Hill's 3-pointer.

Nash went to the bench for good with 2:56 left in the third quarter and his team leading 87-62. It was the second game in a row in which he was able to sit out the final quarter. The 37-year-old two-time MVP made all seven of his shots and had nine assists in Friday night's win over Portland.

Notes: Four of those who played in the game ? Robin Lopez and Morris of the Suns and Brandon Jennings and Ilyasova of Milwaukee ? were not born the last time the Bucks won in Phoenix. ... The 24-game home streak for Phoenix matched a franchise record set against Sacramento from 1988-98. ... The Bucks trailed at halftime for only the second time this season.
